Introduction

Welcome to The Hitting Log LLC ("The Hitting Log," "we," "our," or "us").

These Terms of Service govern your access to and use of our website, applications, and services.

By creating an account or using The Hitting Log, you agree to these Terms.

Eligibility

Account owners must be at least 13 years old. Users under 13 are not permitted to create or maintain an account with The Hitting Log, and parent or legal guardian permission does not override this minimum age requirement.

Users ages 13 through 17 may use The Hitting Log only with permission from a parent or legal guardian and must affirm that they have received this permission. Users age 18 or older may create and use an account without parent or legal guardian permission.

Parents and legal guardians are responsible for supervising minors ages 13 through 17 who use the service with their permission.

Accounts

You are responsible for:

• Keeping your login credentials secure.
• Providing accurate account information.
• Maintaining the security of your account.
• All activity that occurs under your account.

Subscriptions & Billing

Some features require a paid subscription.

Subscriptions automatically renew unless cancelled before the next billing period.

Payments are securely processed through Stripe.

Subscription fees are non-refundable except where required by law.

We reserve the right to modify pricing with reasonable notice.

Acceptable Use

You agree not to:

• Violate any applicable laws.
• Attempt unauthorized access to our systems.
• Reverse engineer or copy the application.
• Upload malicious software.
• Interfere with service availability.
• Use the platform for fraudulent purposes.

Athlete Data

You retain ownership of the data you enter into The Hitting Log.

By using the platform, you grant The Hitting Log LLC permission to securely store and process that information, including through service providers described in our Privacy Policy, solely as necessary to provide, protect, and operate the services offered by the application.

Artificial Intelligence Features

Certain features of The Hitting Log use artificial intelligence and third-party AI technology, including services provided by OpenAI. When Hitting Log AI requires an AI-generated response, The Hitting Log may transmit the user's question, selected calculated performance information, relevant context, and a pseudonymous account identifier to OpenAI for processing, as described in our Privacy Policy.

Hitting Log AI responses are generated automatically. They may be inaccurate or incomplete, may misunderstand a question or the available performance data, or may occasionally contain unexpected or inappropriate information. AI-generated responses are provided for informational and educational purposes and should be independently evaluated.

Hitting Log AI provides general baseball and softball performance insights and information. It is not a substitute for individualized instruction from a qualified coach, trainer, medical professional, or other appropriate professional. Hitting Log AI does not provide medical, healthcare, injury, rehabilitation, legal, financial, or other professional advice.

You are responsible for evaluating AI-generated information before acting on it. You should not rely solely on an AI response when making decisions involving health, injury, safety, or other significant matters.

Hitting Log AI is available only to users who are at least 13 years old. Users ages 13 through 17 may use Hitting Log AI only with permission from a parent or legal guardian.

Hitting Log AI depends partly on third-party technology and services outside The Hitting Log's direct control. Its features, output, availability, and underlying technology may change, be updated, be modified, or become temporarily unavailable.

Intellectual Property

The Hitting Log™, The Hitting Log LLC, HLP Score™, all proprietary analytics, branding, logos, graphics, software, website content, and application design are the intellectual property of The Hitting Log LLC.

They may not be copied, reproduced, distributed, reverse engineered, or used in competing products without prior written permission.

Availability

We strive to keep the service available at all times but cannot guarantee uninterrupted operation.

Maintenance, updates, internet outages, or unforeseen technical issues may occasionally affect availability.

Some features, including Hitting Log AI, depend on third-party services. Interruptions, changes, or limitations affecting those services may affect the availability or operation of related features.

Termination

We may suspend or terminate accounts that violate these Terms.

Users may cancel their accounts at any time.

Cancelling a subscription prevents future billing but does not automatically refund previous payments.

Disclaimer

The Hitting Log provides baseball and softball statistics, analytics, AI-generated performance insights, and player development tools for informational and training purposes.

Neither The Hitting Log nor Hitting Log AI guarantees an improved batting average, improved statistics, athletic development, playing time, team selection or roster placement, recruiting outcomes, scholarships, college opportunities, professional opportunities, or any other particular athletic result. Athletic results depend on many factors outside the application's control.

AI-generated responses and other analytics may contain errors or may not reflect every factor relevant to a player's performance. Users remain responsible for independently evaluating the information provided through the platform.

Limitation of Liability

To the fullest extent permitted by law, The Hitting Log LLC shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the platform.

Our maximum liability shall not exceed the amount paid by the user during the twelve months preceding the claim.

Changes

We may update these Terms periodically.

When significant changes are made, the Effective Date will be updated.

Continued use of the platform constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Texas.
